This legal notice and these terms govern the use of davidalegria.com and its shop, the studio website alegria.es and our escape games: their websites (escapebull.com, elcorsariodebilbao.es, elsecretodebenjamin.es, 1521elasedio.es and 1942caminoalalibertad.es), the game platform play.alegria.es and its checkout (together, the “Service”). Throughout this text, “we”, “us” and “our” refer to David Alegria S.L. (“David Alegria”), and “you” refers to the person who visits the websites, buys or plays.
By visiting our websites, buying or playing, you accept these terms and the policies they refer to, in particular the Privacy Policy. Please read them carefully. If you do not agree with them, do not use the Service.
In accordance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI), we inform you that the owner of the Service is:
David Alegria S.L.
Tax ID (CIF): B71022198
Address: Carmen, 22. 31001 Pamplona (Navarra), Spain
Email: info@davidalegria.com (for the games, games@alegria.es)
You may use our websites freely to find information, buy and play. You may not use them for any unlawful or unauthorised purpose, or in any way that could damage them or prevent others from using them. In particular, it is forbidden to: (a) pursue any unlawful purpose or ask others to do so; (b) infringe our intellectual property rights or those of third parties; (c) harass, insult, defame or discriminate against anyone; (d) provide false information or impersonate another person; (e) upload or send viruses or any other malicious code; (f) collect personal data about third parties; (g) send spam or engage in phishing; (h) try PINs or coupons in bulk or by automated means, or extract content using bots; and (i) circumvent or interfere with the security features of the Service. We may block access to anyone who does not comply with these terms.
The texts, designs, illustrations, photographs, logos, trademarks and code of our websites, as well as the games (their story, puzzles, solutions, maps, images and sounds), belong to David Alegria or to their authors and are protected by law. You may not reproduce, copy, distribute, transform or exploit them, or share the puzzles or their solutions, without our express written permission, except for your own personal use when visiting the websites or playing.
We try to keep the information on our websites accurate and up to date, but it may contain typographical errors, inaccuracies or omissions (for example, in descriptions, prices, availability or delivery times). If we find an error affecting an order you have already placed, we will let you know and you may choose either to go ahead with the corrected information or to cancel the order and get a refund. Some pages may contain historical information which, by its nature, is not current.
Prices are shown in euros and include VAT. Shipping costs for the shop, if any, are shown before you complete your purchase. We may change our prices at any time, but changes do not affect purchases already made.
Payment is made on the secure page of the payment gateway: in the shop, through Shopify’s checkout; for the games, on Stripe’s page (by card and, depending on the case, other methods such as Bizum, Apple Pay or Google Pay) or, where offered as an alternative, on the page of Redsys, our bank’s virtual card terminal. We never see or store your card details.
Our shop is hosted on Shopify, which provides the e-commerce platform we use to sell our products.
We have made every effort to display the colours and images of our products as accurately as possible, but we cannot guarantee that your screen will reproduce them exactly. Some products may be available in limited quantities. We may limit the quantities per order or refuse orders that, in our judgement, are placed by dealers or resellers; if we do so with an order that has already been paid, we will refund it.
When you buy, you must give us complete and accurate details (name, shipping address and email) so that we can complete your order and contact you if necessary.
Delivery times and costs, the right of withdrawal (14 calendar days from receipt) and how to return a product are explained on our Shipping and returns page. All products come with the three-year legal guarantee of conformity provided by consumer law.
What you buy
Each game entitles you to play one of our outdoor escape games once, from your phone’s browser, following its route. To play you need a phone with an up-to-date browser, an internet connection and enough battery; access to your location is optional. Each game’s website shows its route, duration, recommended age and accessibility.
Purchase and PIN
To buy, we ask for your email and the number of games (up to 50 per purchase). We email you one PIN for each game. If you buy just one, you go straight into it when you complete your purchase.
The PIN is all you need to play: it is not linked to any person and anyone who has it can use it, so keep it as safe as you would a ticket. Several phones can play the same game with the same PIN. If you lose your PINs, write to us at games@alegria.es and we will resend to the purchase email those that have not been started or expired.
Expiry
Each PIN expires after two years if the game has not been started. Once started, the game lasts for the time shown on each game’s website; after that time, it ends. Within that time, you can come back in with the same PIN and continue where you left off. Some games let you extend the time of a game for an extra charge, the price of which is shown before you pay it.
Gifts
You can give games as a gift: we will ask for the email of the person who will play, your own email, your name and, if you wish, a message, and we will send that person the PINs. You remain the buyer for the purposes of these terms.
Discount coupons
Discount coupons are applied at purchase, according to the conditions of each coupon (discount, expiry and number of uses). Each coupon is used once for each game purchased, cannot be exchanged for cash and, if it covers the full price, is only valid for one game per purchase.
PIN cards
Some shops sell cards with a PIN for our games. These terms apply to the game; the purchase of the card, its payment and its return are handled with the shop that sells it.
Closed game
A game may be temporarily closed (because of roadworks, festivals or other reasons beyond our control); the game’s website will say so. While it is closed you can buy games but not start them: you can play them when it reopens, before they expire.
You have the right to withdraw from the purchase of a game, without giving any reason, within 14 calendar days of the purchase, provided the game has not been started. To do so, write to us at games@alegria.es stating the purchase email and the PINs of the games you want to return; you may, if you wish, use the form in section 9. We will cancel those PINs and refund what you paid for them within 14 days at the latest, using the same payment method you used.
When you start a game, you ask us to begin providing the service, and it is fully provided from that moment, so you lose the right of withdrawal for that game (Article 103 of the Spanish consolidated General Law for the Defence of Consumers and Users). The same applies to extending the time of a game, which is provided as soon as you pay for it.
For games given as gifts, the right of withdrawal belongs to the buyer. If a game cannot be played because of a problem on our side, write to us at games@alegria.es and we will find a solution.
Only use it if you wish to withdraw from a purchase. Copy it and send it to games@alegria.es (games) or to info@davidalegria.com (shop):

Our games are played on public roads and spaces, which we do not control. While playing, you must pay attention to your surroundings, follow traffic rules and any instructions from the authorities, not enter private or restricted areas, and respect residents, businesses and heritage. Do not look at your phone while crossing the street. Minors must play accompanied by an adult, who is responsible for them during the game.
Streets change: an element of the route may disappear or be hidden by roadworks or an event. We review our games to keep them up to date; if something prevents you from continuing, write to us at games@alegria.es and we will help you.
When you finish a game, you can publish on the game’s leaderboard a name, where you come from, a photo and a comment. By doing so, you authorise us to publish them on the game’s website until you ask us to remove them, and you declare that you are entitled to use them and have the permission of the people who appear in the photo (for minors, that of their parents or guardians).
What you publish must not be unlawful, offensive, defamatory or obscene, nor infringe the rights of third parties (intellectual property, image, privacy or others). You are responsible for what you publish. We may review, not publish or remove any content that does not comply with these terms.
The comments you send us after a game, or the ideas and suggestions you send us by any means, help us improve; we will not publish them without your permission, we are not obliged to reply to them and they do not give rise to any compensation.
The personal data you give us when using the Service is processed in accordance with our Privacy Policy.
The Service uses third-party tools (for example, the Shopify platform, payment gateways or Google maps) and our websites contain links to third-party sites, such as social networks or WhatsApp. We do not control those sites and are not responsible for their content, products or policies; we recommend that you read their terms before using them. Complaints about third-party products or services should be addressed to them.
We try to keep the Service running without interruptions or errors, but we cannot guarantee it: there may be downtime for maintenance, technical failures or causes beyond our control (such as your phone’s connection or third-party services). We may modify, suspend or withdraw any part of the Service, always honouring purchases already made.
We are not liable for damage caused by use of the Service contrary to these terms, by failure to follow the guidance in section 10, by force majeure or by acts of third parties beyond our control. Nothing in these terms limits the rights the law grants you as a consumer, or our liability in cases where the law does not allow it to be excluded.
If any of these terms is found to be unlawful, void or unenforceable, it will apply to the extent permitted by law, and the remaining terms will remain valid.
We may change these terms to adapt them to changes in the Service or in the law. We will publish the current version here with its update date. Each purchase is governed by the terms in force at the time it was made.
These terms are governed by Spanish law. If you are a consumer, you may bring proceedings before the courts of your place of residence. If you are not, both parties submit to the courts of Pamplona (Navarra, Spain).
Questions about this legal notice and these terms should be sent to info@davidalegria.com or, for the games, to games@alegria.es.
